Uniform Deployed Parents Custody and Visitation Act (UDPCVA)

Over the past several years, there has been an increasing amount of custody and visitation issues involving military parents. To address these issues, the National Conference of Commissioners on Uniform State Laws created the Uniform Deployed Parents Custody and Visitation Act (UDPCVA). North Carolina is one of 10 states that has enacted this legislation to support deployed parents and their families.

The UDPCVA is an act that protects the rights of military parents who are deployed. The UDPCVA is made up of five articles that address the various issues impacting deployed parents in custody and visitation proceedings.

Stipulations contained in the UDPCVA include:

  • A parent being deployed must notify the other parent as soon as possible
  • Courts are not permitted to take past or future deployment into consideration when determining the best interest of a child in custody proceedings
  • Proceedings may be expedited to ensure a custody order is put in place prior to deployment
  • Permanent custody arrangements cannot be made without the consent of the deployed parent
  • There is a specific procedure to follow to terminate a temporary custody agreement
